Since the reform and opening, with the rapid development of China's politics, economy, culture and so on, the requirement of Legal society is growing, the requirements of the party's ability to rule by law are increasingly high, therefore, it has become the inevitable demand of The Times to enhance the ability construction to run the state by law for Chinese communist party. In the basis of the basic strategy "the rule of law" put forward in the 15th national congress of the party, the communist party of China clearly put for the first time: "hang on to rule by law, implement the party leadership over the state and society" in the 16th national congress of communist party of China. The party put in succession the decision to strengthen the party's ruling ability construction in the fourth plenum of the CCP, and put that the basic mode of the part is to rule by law, and put Law-based rule as one of the important goals of enhancing the party's ruling ability. The report of the party's 17th national congress says: "the party's ruling ability construction is related to the party's construction and whole situation of the cause of socialism with Chinese characteristics." Therefore, the construction of the party's ability to rule by law has far-reaching significance for the governing position of the party and national development.The article systematically discusses the ruling ability construction by law of the Chinese communist party on the current from three levels:First, we will make summarized analysis from the theoretical level of the party's ruling ability construction in accordance with the basic connotation and the time request. Firstly, we do system summary about the evolution and rising of the theory and practice of the ability construction to rule by law of the party to four times, the new-democratic revolution period, the founding period before the enlargement of the anti-rightist movement, the anti-rightist movement period, and the reform and opening up period for the background. Secondly, the article analyses the existing problems and causes to the party's ability to rule by law, discussing mainly from the related four aspects, insufficient of the law's advocacy capacity, competence in accordance with the law, the deficiency of the error correction ability and law supervision disability.Finally, in view of the current existent problems about the process of the party's ruling ability construction to rule by law, the article puts forward the basic train of thought in accordance with the party's ruling ability construction at present. One is actively improving the constitution and relevant laws and regulations, improving the party's propaganda ability according to law. Two is rationalizing the party-government interactions, enhancing the party's ability in accordance with the law. Three is to strengthen the legal regulation's learning for all citizens, enhancing the party's correction capability. Four is setting effectively restriction and supervision on party's power operating, enhancing the party's capacity of supervision according to law.The three parts analysis according to the thinking framework of proposing and analyzing and solving problems about the problem of the party's ruling capability construction by law, and the three parts are essential in order to achieve, closely linked to the current party's construction of the ability to rule by law in a thorough and depth.
