On The Operational Practice Of The WTO Trade Policy Review In Typical States

The trade policy review mechanism is the one, which mainly by the WTO members to evaluate and assess every members' trade policies and practice, further the operation of the multilateral trading system. However, perhaps for lack of mandatory legally binding, researches on TPRM are very limited, not to mention the study on their specific operation. Therefore, this paper focus on the discussion of the specific operation of TPRM, comparison and conclusion were made based on that, hoping to find strategies for China to tackle with the TPRM. This paper will be divided into five parts:The first part is the introduction, which introduces the background, basic content and objectives of the mechanism.The second part mainly introduces the institutional arrangement of TPRM, including the operational procedures and criteria. This part makes the conclusion that legal criteria is applicable in TPRM practice.The third part focus on the operation of the TPRM practice, in order to find the manner of national trade policy review practice. After the introduction of the USA accepted 1996, 2008, 2010 review practice, Japan accepted 2009 review practice and India accepted 2007 review practice, the TPRM is considered to be generally found around the country's economic environment, trade policy and institutional framework, trade policy and trade-related measures, sector policies, prospect, and several other aspects. The practice will give more consideration on members'unfavorable international trade policy, also be inconsistent with the WTO obligation commitments and urge the country to correct them. But when it comes to the correction, it depends on cost and benefit trade-off.The fourth part introduces the practice of the TRPM in China and China's reactive strategies. Three review practices are induced respectively and further reactive advises. Mainly on the attitudes of fearlessness and communication, on the preparations of fully, actively cooperation between the ministries, and attach importance to the Government report writing, and careful formulation of trade policy.The fifth part is the conclusion for the whole paper.In this paper, case analysis (review practice of China, US, India by TPRM), interdisciplinary research methods (for instance, Economics and Laws), Literature research methods (the TPRM review report), Comparative Analysis (comparison TPRM review among USA, Japan, China and India) were utilized.
