On Problems Of Our Lawyer System And The Countermeasures

Lawyer is an important power to assert the basic rights of the clients, and the lawyer system is about how to use the power, concerning the management system, the rights system, the charge system, the legal aid system and the professional ethics. Recent years, with the quickening pace of reform and opening up, our lawyer system has grown to mature. However, we cannot ignore that the current lawyer system and the lawyer service are still far from meeting the needs of our economic development, and certain degree of misunderstandings are still exist in many people's mind.How to realize the lawyer? How to perfect the lawyer system, leading more and more people to understand the lawyer and the lawyer system for fasting our modernization and legal contribution? With these questions, I probe the origin and development of the lawyer system, through which analysis the deep meaning and the basic character of the lawyer system. At the first part, I force on the origin, development and the basic character of lawyer and the lawyer system, aiming at calling the general understanding about the great use of the lawyer system, and strengthen our law concept.On the third part, I mainly focus on the current situation of our lawyer system, and the challenge of our lawyer system. In this part, I list five parts of the lawyer system to explain the recent situation of the system, as the management system, the rights system, the charge system, the legal aid system and the professional ethics. And also give a general introduce of the challenges coming along.As the last part, I mainly research the countermeasures for the challenges listed before. The revolution of the lawyer system should be realized from deferent aspects. As from the managing system, we need give full play to the judicial organ, lawyers association and law firms, make the role of the tripartite lawyer team together well managed. As from the rights system, we should protect the legal rights of lawyers from the legislation, judicial and social practice.While from the aspect of charge system, we need a reasonable charging principle, and strictly regulate the charging behavior, and set a good lawyer image. At the aspect of legal aid system, we should continue to improve the contribution of the system from strengthening legislation and completing the propaganda, and form good aid ethos. As for the professional ethics, we must strengthen the self-construction and establish of lawyer team, and establish multilateral effective supervision mechanism, and disconnect the chain of interests among lawyers, judges and prosecutors.
