Study On Reform Of The Ship's Nationality And Registration System

As an important measure of ship management and maintaining shipping security, ship's nationality registration system has formed a diversified development trend after continuous development and improvement. With the rise of the flag convenience ship system, today registration of the ship's nationality is no longer simply understood as an administrative tool, but rather considered as a commercial activity. The commercial operation of ship's nationality registration not only has an impact on the traditional ship's nationality registration, but also has brought the enlightenment for us. How to make use of ship's nationality registration system reasonably in the market economy is the key point of reform in the new period.Reviewing the evolution of ship's nationality registration system in the world, we may see that the development process of this system is, in fact, the result from the mutual game between the strict registration and open registration. The former is reasonable in law and jurisprudence; the latter is reasonable in economy and market. Based on study and comparison and combined with the reality of our shipping industry, choosing an appropriate middle road is the direction in reforming our ship's nationality registration system in the new situation.This article is divided into 3 chapters.Chapter One begins with the concept of the ship's nationality registration and places emphasis on its meaning and important role, and then introduces the existing ship's nationality registration systems in the world and the development of these systems.Chapter Two compares practice of ship's nationality registration systems in different countries and tries to find out the advantages and disadvantages of different kinds of registrations and seek some successful experience for our reference in reform of ship's nationality registration system in China;Chapter Three puts forward a new type of design for reform in ship's nationality registration system in China on the basis of study and analysis of the implementation of the special tax-free case policy and the successful experience of ship's nationality registration system in Hong Kong.
