This essay aims to explore legal protection and relief of the teacher's rights and interests in our public primary and secondary schools. The rights of teachers are all various legal rights shared by the teacher, and it is an important issue in the current field of educational law and legal status. To protect the legitimate rights teachers for maintaining teacher's professional dignity and social prestige and a clear legal status, improving teaching quality to promote educational reform and education work has important theoretical and practical significance. However, in real life infringing the rights of teachers often happens which has a serious impact on the process of our rule of law and administering education due to slack laws. We should improve legislation of education and effectively protect the legitimate rights of teachers under the educational legislation and judicial practice。In this paper, various phenomena and behaviors of the current invasion of our public rights of teacher's are critically analyzed and legally reflected using legal analysis, literature, comparative and case law .And operational recommendations are proposed to effectively protect teacher's legitimate rights.At first it describes professional rights of teachers and general rights of teachers as citizenship and their legitimate basis of the protection. Then it analyzes phenomena of current invasion of our public primary and secondary school teacher's various legal rights and interests using legal analysis and case law and pointes out its reasons behind.Finally, from the analysis above, it proposes how to effective protect teacher's rights and interest under the law from several aspects such as legal status, establishment legal relation between educational administrative departments and schools, improvement of the educational legislation, expansion of channels for relief teacher's right and intensive supervision. |
