Concerning The Harmonious Constitutionalism

The Constitution of the People's Republic of China is the basic law and the declaration and guarantee of human rights in China. Constitutionalism is the political formation and process which are based on the constitution, focus on the democratic politics and intent to protect human rights. Rule of law is valuable for promoting justice and protecting human rights. Its functions are avoiding autocracy and limiting the rights of government. From the view of formation, rule of law requires all the laws and regulations, which are based on the constitution, transforming from static to dynamic. In other words, the precondition of rule of law is the rule of constitution. Socialist harmonious society is the world people seeking for. It needs harmonies in different areas including economy, politic, culture and etc. Among these, the harmony in politic is represented in the harmony of constitution. Therefore, it is very important to get out of the dilemma of constitutionalism development, promote the proposal of harmony constitutionalism, study the problems of Chinese politic according to the law and constitutionalism and address the key points and innovations of building harmony society.
