Labor dispatching as a kind of new employing way, entered our country in the early 1990s, became a new industry quickly. Although it is not the main work of form, but it developed rapidly, thousands of labor agency or special labor dispatching company have been established, and engaged in dispatching business; Business expansion all walks of life and number of dispatched workers is also growing rapidly. Its emergence really has very big function to push the business enterprise development and social employment etc, but with a lot of problems, especially with labor dispatch relevant legal norms of blank, make worker' s rights are infringed when the time is not effectively resolved, it is imperative to establish policies and regulations. But the latest promulgation of "Labor Contract Law" resolved some problem to a large extent effectively. Such as the establishment of the organization, shall apply the provisions of the scope, the division of responsibilities. But there are many neglected areas such as the establishment of labor dispatching company, management deficiencies; Labor dispute settlement system is not clearly defined and so on. This article for the "Labor Contract Law" on labor dispatching, From the basic concept of dispatch, the current situation of the existence, and Study of their legal relationship, found that the current problems of dispatching, Suggestions from the government legislation, enhancing the industry regulator and enhanced laborer individual protection consciousness...Etc.
