The Research On Legal Issues Regarding Improvement Of Urban Garbage Management In China

Urban garbage mainly refers to urban living garbage, commercial waste, and wastes collected by the municipal maintenance and management. In the process of urbanization, the wastes as the city metabolic products, burdened with urban development before, many cities of the world have been besieged by the wastes. Today, with the concept of recycling economy, the waste is considered as the most development potential, and never exhausted "urban mines" and "misplaced resources". It is deeply embedded and perceived by the wastes, as well as necessary required by urban development. The law should focus on the solid waste recycling, which can reflect the senses of treatment in the source and control of whole process. That effective pollution prevention and treatment of urban waste, is of great significance to promote the smooth progress of the socio-economic development and to establish an environment-friendly society.The legislation of urban waste pollution control is still staged of the infancy in China. There are some relevant rules in the existing laws from the country's Basic Law to the individual law, but related to specific legal system, there are still many problems. In order to expedite pollution problem of city waste, this paper is analyzed the characteristics, hazards, values and current managements on the urban wastes, and sorts out the law management system on the waste pollution prevention in China. The paper is probed into the existence of the problems and deficiencies, described the United States, Germany, Britain, Japan and other countries of the Circular Economy Legislation situation, and mature experience. This paper, combined with the actual situation of China, on the basis of full investigation, is mainly recommended some points as following: to adhere to the scientific development concept and circulation economy as the guiding ideology of the new legislation, to achieve the legislative system of municipal waste recycling, detoxification, reduction, to establish a market economy management system and use a variety of flexible model management of urban waste, to strengthen the special laws and regulations on city waste.
