Electronic waste does have much harm to the environment, but alsohas the characteristic of being resourced, which makes recycling it possible.In recent years, the number of the electronic waste of our country hasbecome bigger, while the recycling work has been carried out slowly. Du tothe slow development of the technology and legislation in the aspect ofrecycling, our domestic products are often subject to the green tradebarriers of developed countries in the international trade.But we can not avoid facing the bad condition of electronic wasterecycling in our country. There are some problems in mainly four aspects,these are, the disorder of the recycling market, the old recycling method,the lack of legal legislation for the secondary market and the lack of theawareness of the urban residents in recycling the electronic waste. At thesame time, the law building has not been completed very well, especiallyweak in the aspect of operation. The latest legislative requirement, that is,the legal regulation for the recycling of electronic waste was put in topractice in January1st2011, but it still has some shortcomings.The legislative priority of the law is mainly about the regulation of dealingwith the electronic waste in the end. In addition, other specific legislationsalso have many problems. For example, the legislative level of them are toolow, the legislation of EPR system is imperfect, the legal mandatoryinsufficient. Besides, there are also many problems in two relevant basiclaws. The Specific legal provisions for the electronic waste are imperfect.Circular Economy Promotion Law provides for EPR system, but it is notoperable because it only stays on the surface of the legal articles.In contrast, most developed countries, such as Germany, Japan and so on, have generally adopted the perfect EPR system in the provisions of theelectronic waste recycling. At the same time, they have already set up therecycling system compatible with their national conditions. When ourcountry builds the legal system of the electronic waste recycling, ourgovernment should consider the basic national conditions of our existingpolitical, economic and cultural aspects. Meanwhile, we can alsoselectively borrow some existing system building experience from thedeveloped countries and take full advantages of the existing local resourcesand systems. In details, our government should make further improvementin the building of the basic special legislation and supporting legal system,building the perfect EPR system for our country, constructing themulti-level recycling system and the legal regulation system for thesecondary trading market, clearing the government responsibilities andimproving the information guiding system as well as the public educationsystem.
