With the development of institutional repository, the copyright issues involved in the building and development of the institutional repository are becoming the focus of attention. How to solve the copyright issues involved in institutional repository, to avoid the risk of copyright and to avoid copyright disputes has become one of the core issues of sustainable development of institutional repository. This paper argues that solving the copyright problem is an important condition for sustainable development of the institutional repository, national legal environment which is copyright law and contract law is the legal basis for institutional repository to develop effective copyright policy. Through the analysis of the relationship of institutional repository stakeholders, it points out that the copyright agreements are the legal norms for the author, institutional repository, publishers and the institutional repository users to adjust their copyright rights and copyright obligations, the legal relationship between them can be adjusted by store license agreement, copyright transfer agreement and Creative Commons License. In addition, the implementation of mandatory open access police is beneficial for institutional repository to solve the copyright issues. On this basis, combined with the copyright system and the legislative practice of countries, through the analysis of copyright agreements application in institutional repository on the open access environment, this paper sums up experience and shortage, develops its own copyright policy proposals in hopes of promoting the relevant aspects of theoretical research and promoting the rapid and healthy development of institutional repository.
