On The Copyright Management Of Open Access In China

Open access can reduce the resistance to access scientific achievement, it make scientific achievement spread more widely, And it can also accelerate the development of productivity as well as the prosperity of economy and culture. Present discussion to copyright management of open access mainly focus on what kinds of owners' rights should be protected and how to ensure the rights of free license can be used in a reasonable way. Dealing with copyright management needs to balance every stakeholder's benefits, satisfy the greatest benefits of stakeholders to reduce conflict.Comparing the domestic and foreign copyright management mode of open access journals and repositories, this paper discovers that copyright management of open access are short of unified guiding principles in China, it isn't beneficial for a long-term development. The transformation of open access journals still lead a primary position in copyright relationship, It is not good for the copyright management of other open access organizations, and the paper domination of the authors. There are also some defects in rational use of open access paper, including lack of relief mechanism, the responsibility system of users is missing, the provisions of open access repositories index open access papers from Journals are not clear, and so on.Aiming at these problems, and combining our situation with advanced copyright management method overseas, this paper suggests to strengthen administrative supervision, promote inherent system perfection, establish correlative regulations, thus construct a frame to push the healthy development of copyright management of open access in China.
