Special education is an important component in the education system. Right to education is the product of the development of human society to a certain stage, the symbol of human development, social progress and civilization. Children with disabilities should enjoy the right to education as a fundamental right, and be given positive protection by the state, society, school and family. The right to education of children with disabilities is a constitutional right, whose emergence and development has gone through a longer period. Whether children with disabilities have got the equal educational right or not is the most concern during the development of special education.In view of international human rights point, special education guaranteed by the legislation has become a fundamental scale to measure whether persons with disabilities enjoy equal human rights, which is also the only way to guarantee the development of special education. As a great power of education, the essence of the United States'constitutional right to equality is the equal education; Its educational equality for children with disabilities reflect the American concept "men are created equal" better.The U.S. federal government enacted laws reflecting the U.S. Congress attaching great importance to children with disabilities. The legal system makes the right to education of children with disabilities protected by the legislation. The form of the existing laws in China is just made for provision of education for children with disabilities, it is necessary from a legal perspective to regulate the right to education of children with disabilitiesBased on the study on protection of legislation of right to education of American children with disabilities, we can provide the reference to promote the rapid development of our special education.
