Because right to compulsory education is the fundamental and core content ofthe right to education, the children with disabilities should enjoy the equal rights aswell as other children. Although Chinese government has made certain progress inprotecting the rights to compulsory education of children with disabilities, the legalprotection of the rights are still full of problems. Because the legislative protection ofthe human rights is the starting point of the legal protection of human rights, thearticle discussed problems about the legislative protection of the right to compulsoryeducation of the children with disabilities.Firstly, the article defined and described the meanings of “right to education”and “children with disabilities”, and on this basis, defined the meaning andcharacteristics of“the right to compulsory education of the children with disabilities”.Secondly, the article discussed the contents of the right to compulsory education ofthe children with disabilities and analyzed the rights of children with disabilities andthe duties of state and other subjects of duty. Thirdly, the article analyzed the currentsituations and the problems of the legislative protection of the right to compulsoryeducation of the children with disabilities in China based on summarizing the legalsystem about the compulsory education of the children with disabilities and thelegislative experience of other countries and regions. Lastly, the article discussed thesuggestions about the the legislative protection of the right to compulsory educationof the children with disabilities in China from the special legislation, subjects ofrights and duties,the measures of protection, legal obligations and legal remedies.Based on the needs of researcher, the article used the methods of semanticanalysis, method of comparative analysis and method of examples.
