Low-carbon economy is a turning point which can promote the energy revolution and the production technology revolution, as well as the best economic model to improve human environments and sustainable developments. Although the low-carbon economy is likely to be developed as a tool to contain China's economic development by developed countries, we can not deny that the concept of low-carbon economy and their proposals are well-intentioned, which can advance the social costs to the economy mode of positive externalities. Therefore, the author believes that the low-carbon economy can be a policy which can bring benefits to our posterity if our country can get its pith, combining scientific thought of sustainable developments, making good use of its subsequential advantages by means of the constraint our government and policies.From the economics of law point of view, I have a preliminary discussion on the development of the low-carbon economy in our country, which can be divided into five parts. In the introduction, in addition to the international and domestic background of low-carbon economy, I explained that too many carbon emissions effect the environment of China and other countries all over the world a lot, and summed up its practical and theoretical significances combining series of recent extreme weather events in China.In the first part, I analyze the economic theories of the low-carbon economy according to the theory of the social costs and externality, environmental economics and public management, government regulation, property rights theory and technological innovation I come a conclusion that the question of low carbon is just like the question of negative externalities and the best way to solve is to innovate our technologies, system and our government regulations. And then during part two, I analyze the status of the low-carbon economy in China, where the low-carbon economy just begin, so there is still a long way to develop it nd many obstacles to overcome---- such as the structural problems caused by China's energy resource endowments, the technological innovation problems originated from the low level of the energy technologies and a series of system deficiencies which should be faced by our country and demand urgent solution. During the third part, taking the representative developed countries such as the United Kingdom, the United States, and Japan as examples, I analyze their policies and regulations related to low-carbon economy and sum up their experiences so as to provide reference for China's low-carbon economy. Finally, the author put forward the goals, approaches and system suggestions of the development of low-carbon economy in China, according to the preceding discussion. I believe that energy strategic guidance should be made first on the premise of the "no regrets" emissions reduction targets; followed by a long-term future development plan of the low carbon economy. Finally, when the government shapes relevant systems and regulations, they should mainly be based on economic incentives policies, and through the analysis of China's current economic situation and compared with the characteristics of carbon taxes and carbon trading, the author come a conclusion that carbon taxes play the leading and efficient role in the short-term transition process of China.
