Strategic Analysis Of Intellectual Property Protection For Tire Manufactures

Nowadays, Chinese tire manufactures had gained huge development because of the low labor cost and low cost of raw materials in China. Last year, the amount of Chinese tire exporting was up to the biggest. With the enormous progress, the Chinese tire industry had been more and more challenged by manufactures from other countries, mainly by the way of intellectual property litigation. Meanwhile, famous tire manufactures, such as Goodyear and Michelin, had established factories in China in order to share the Chinese market. Chinese tire industry would be trapped by these famous tire manufactures if this trend went on. Although the main body of intellectual property protection system, mainly by the way of trademark, patent and business secret protection, had been established which was mainly in line with the international intellectual property protection system, Chinese manufactures were lack of activities to protect their intellectual property. To change this situation, we had to complete the intellectual property protection system from the aspect of the industry itself. This thesis analyzed the structure and composition of tire as well as the concrete Chinese legal documents and gave some proposals on how to tire enterprises.The first part of this thesis introduced the tire structure, including the raw material, the body structure and the tread pattern which should be protected by different ways, and its corresponding intellectual property rights. The second part was concerning about the scope of the trademark protection and the well-known trademark protection. The third part introduced the scope and limitations by the way of trademark protection and analyzed the deficits of the legal system. The forth part mainly introduced the content and advantages of the business secret protection in the tire industry. According to the law, the way of business secret protection was the most important way of intellectual property protection. Of course, these different protection ways should be combined together to achieve a better result of protecting the intellectual property rights of these tire enterprises.
