Since the consumer protection movement engendered in the 19th century, it has been booming and consumer protection also became a hot issue studied by many economic law scholars. When it came to the 20th century, along with social economy entering into monopoly, the conflict between monopolistic operators and consumers became to intensify as a result of market failures. Consumers began spontaneously to compose social organizations so as to counterbalance monopoly operators. This trend proliferated in the world-wide proliferation and a large number of consumer groups and organizations emerged around the world. At the same time consumer organizations began to have huge impacts on national legislations. China Consumer Association established in 1984. Among the various hot spots the nature as well as the position of China Consumer Association continue to catch close attention. Article 12 of Law of the People's Republic of China on Protection of Consumer Rights and Interests explicitly provides consumers enjoy the freedom of association. Article 31 also determines the legal status of other consumer organizations as social groups. But China Consumer Association is the only consumer organization in China, which is positioned as a quasi-government organization. Through the years of Implementation of Law of the People's Republic of China on Protection of Consumer Rights and Interests, research on the right to association and the functions of consumer associations can't be rich. This essay comprehensively take semantic analysis method, history investigation method, comparison research method, case analysis method and summarized and comparison analysis method to analysis the development of consumer organizations, their functions and operation problems. The author wish to provide some theory support to the diversification of consumer organizations in China, promote the establishment of more consumer organizations and finally form diversified autonomy"small government, large society".This essay consists of the following parts:Introduction is about the background and significance of this article, the main research content and methods.The body parts include four chapters.Chapter one is on the consumer theory of organization and function of basic cognitive issues. First, the author defined the concept of consumer organizations. Second, the writer analysis their basic characteristics in order to explicit that consumer organizations are to protect consumers'interests and their non-profit property. At Last, the author analysis the present situation of China's consumer organizations and their functions, analysis the necessity of development of consumer associations and other consumer organizations.Chapter two explains theoretical basis for the diverse development of consumer organizations. The essay mainly analysis from the angle of history and positivism, horizontal angle of comparative law, political science and jurisprudence angle, to reveal the theoretical basis for the diversification of consumer organizations. Since movement of consumers and consumer organizations engendered, consumer organizations presented diversification characteristics; as an important component of social groups, its diversification development continues to be the need of intrinsic value of the social development. At the same time, Constitution Law, Consumer law etc, clearly define and provide a firm basis for its development and prosperity.Chapter three is about several basic functions of non-government consumer organizations in China. In terms of external functions, consumer organizations should participate in constituting national economic policy; supervision the government's economic policies implemented as well as the business operators. In terms of internal functions, consumer organizations should be instituted on behalf of the consumer group litigation qualifications; guide for consumers, such as education, help and support.Chapter four makes some constructive suggestions based on the above discussions. We should hold an active encouragement attitude towards association, and improve the legislation and the related legal construction; reconstructing the relationship between consumer associations and other consumer organizations, encourage the diversification of consumer organizations.Conclusion reaffirms the essay's main statements.
