Social assistance is the center of the social security system nowadays, the right of social assistance has been a fundamental right appeal between individual and the government. However, because of the wrongly discriminating and mistakenly value proposition of the social assistance right, the framework and the performance of social assistance system do not work well in our legal and social practice. In the current academic circles, the orientation of social assistance rights is usually from the rights concept of natural law and the value orientation is eliminating poverty and making the poverty-stricken people have the ability to change the poor. In this article, the performance and value of social assistance right are not eliminating poverty, but only in ease of conflict and contradiction between the rich and the poor. Therefore, this paper firstly examines the history and theory origin of the social assistance right. Then have demonstrated the right of social assistance source, value rationality and function effectiveness from the perspective of utilitarianism. On that basis, analysis of the current social assistance dilemma, discussed the value of social assistance right ideals.
