Study On Legal Issues Of Environmental Protection In International Investment Agreements

With the development of global economic integration, the extent of the international investment are further enhanced. International investment has become an important form of the modern economic activities. But at the same time environmental problems in international investment are becoming prominent increasingly, and have become huge pressure and challenges of society. Environmental damage produced by International investment has become one of the focus of international problems.International investment is a double-edged sword,which has its advantages and disadvantages. Based on the relationship between international investment and environment, this paper analyzes the legal issues of environmental protection in international investment. It puts forward measures to perfect the law system of environmental protection in our country's investmental law.The first part of the paper mainly discusses the basic situation of international investment as well as the present global environmental problems from international investment, international investment liberalization and globalization and environmental protection. From these existing situations, the first part also analyze the relationship between international investment and environmental protection.The second part mainly studies the related clause of International investment agreementsthe signed among countries. Especially taking the north American Free Trade Agreement and other agreements signed in recent years with China as a priority, the paper involves the environmental protection investment agreement terms of environment protection in general, the different attitudes of environmental protection and environmental protection in the form of international investment agreements.Based on the second part,the third part chiefly discuss on the international investment agreements concerning environmental protection clause in the effectiveness and the validity of the environmental protection, analyze the conflict of environmental protection in the international investment agreement terms, discuss the effect of environmental protection and investment and its reason.The fourth part mainly analyze the coordinationable conflict between the current international investment and environmental protection, and our country's current international investment in the present status of environment protection and on China's environmental problems, and proposes the corresponding improvement suggestions in order to make effective use of international investment to improve our economy and better protect our environment, improve the environment quality conditions.
