| With the rapid development of the global economy,the pace of investment liberalization has also accelerated.While the economy is in a rising stage,problems related to the environment are also increasingly emerging.The negative impact of investment activities on the environment has undoubtedly attracted people's attention.In order to balance the relationship between international investment and environmental protection,it has become a recognized practice for all countries to include environmental protection clauses in international investment agreements.It is inevitable for international investment agreements to include environmental protection clauses,which can not only enhance the international community's attention to environmental protection,build a good investment environment,but also implement the principle of sustainable development.In international practice,the environmental protection clauses in investment agreements are more specific.Represented by the North American Free Trade Agreement(NAFTA),it has increased the contents related to environmental protection to varying degrees.In the international investment agreements signed by China,the important position of environmental protection is emphasized.However,due to the current development stage of China's environmental protection provisions,there are still many problems:the content of environmental protection provisions is not perfect,there are defects in legislation,and there are conflicts with other provisions.Therefore,China should actively learn from the provisions on environmental protection clauses at the international level,improve the contents of environmental protection clauses in China's international investment agreements,make up for the defects in legislation,coordinate conflicts with other clauses,create environmental protection clauses with Chinese characteristics,and promote China's leading power in the formulation of international rules in the field of environmental protection. |
