In the modern social development process, the real estate industry plays an more and more important role on a country's economic development. "The water that bears the boat is the same that swallows it up". When the real estate prices is at rational state, the healthy and orderly development of real estate industry can bring the economic interests of the whole society. On the contrary, if the real estate prices rise irrationally, it will lead to countries and even worldwide economic collapse. According to the relevant scholars'investigation, since the seventeenth century, there are about 42 times serious global economic crisis. And 21 times of them have closely relationship with the irrational development of real estate industry.As Chinese economic system reform advancing, the real estate industry development is paid more and more attention in the society. As the leading and the pillar industry of Chinese national economy, whether the real estate industry develop healthily and coordinately is the key point to affect economic stability and development. But because Chinese real estate industry structure is not scientific and the legal regulation is not sound, the real estate prices rise irrationally. In recent years, China's real estate prices continue to rise, we should rationally treat to it. On the one hand, because China's sustained rapid economic growth spurred national consumption level, and the advancement of urbanization increased the demand of Commodity house rigidity. On the other hand, the economic crisis caused by real estate bubble in Japan and other countries warn us that the irrational price rises caused by the speculative buying and the unreasonable price structure must be restrained finally. This needs the government to strengthen macro regulation ability, establish and perfect the relevant systems and laws and regulations, and ensure the healthy development of real estate in China to ensure sustained economic coordination development.Except preface, there are four parts in this article.The first part, China's commodity house price overview. It defines the meaning of commodity house, and introduces the evolution of the system of house in China. The second part, analyzing of the reasons of the high price of house in China. From the two aspects of policy system and civil law system, it reseaches the form of the high price of the real estate, this paper analyses the reasons that Chinese commodity house price growth irrational basic reason. The third part, the legal adjustment of the house price. Discusses the legal regulation of the price of commercial housing legislation evolution and the current legal system to the real estate price adjustment to find suitable for China's national conditions of commodity house price adjustment of legal protection system. The fourth part, the price adjustment house in China, the perfection of legal system. In view of China's housing price adjustment in the defects existing in the real estate price adjustment, the reference of foreign experience, proposed our country house price adjustment measures for perfecting the legal system.The innovation of this paper is that the analysis of the house in China, and put forward the price adjustment of the shortcomings of the legal system of, and through the comparison of the system with foreign related reference, and put forward the corresponding system construction method.
