Research On Relationship Between Competition Authorities And Sectoral Regulators

Relationship between competition authorities and sectoral regulators is not only the concrete manifestation of relationship between competition policy and industrial policy, but also the manifestation of national economic policy, directly concerning to the effectively implement of the antitrust law in banking. With the sample of jurisdiction dilemma in competition enforcement of banking, this thesis discusses the relationship between competition authorities and sectoral regulators in banking of competition enforcement, including the value of competition authorities and sectoral regulators, role arrangements and relations between them and how to build the relationship to better promote orderly competition in China's banking industry and protect consumer interests. There are four chapters in this thesis:Chapterâ… : Jurisdiction dilemma of competition enforcement in Chinese banking. Beginning with the case of antitrust jurisdiction dispute in banking, this thesis analyzes the embarrassing relationship between competition authorities and sectoral regulators under"Antitrust Law", such as relationship of exclusive jurisdiction between competition authorities and sectoral regulators, relationship between"Antitrust Law"and"Commercial Banks"and so on, which consider the necessity to clarify the relationship between competition authorities and sectoral regulators.Chapterâ…¡: Value and comparison between two agencies in banking of competition enforcement. The part analyzes the framework of the banking competition and monopoly regulation, deeply discusses the value and inferior of competition authorities and sectoral regulators and then further compares the two agencies. The agencies have different disadvantages and features in banking of competition enforcement. How to arrange their own roles to achieve the maximum effect is key to the effective antitrust enforcement.Chapterâ…¢: Relationship between competition authorities and sectoral regulators. This chapter is part of the article's core argument, which analyzes coordinated interaction of competition authorities and sectoral regulators in banking of competition enforcement. The agencies maintain an interactive relationship which imply independence and infiltration, intersection and complementary, conflict and convergence, constraints and collaboration. They can not be replaced by each other, and work closely to achieve the effective implementation of antitrust law in banking, promote fair competition in banking and economic efficient operation, and maintain consumers and social public interests.Chapterâ…£: Building relationship between competition authorities and sectoral regulators. This section analyzes the hinder of the agencies relationship building in legislation and enforcement, and puts forward specific optimization on the basis of the jurisdictional dilemma. This part points out that, government should enhance the adaptability and uncertainty of "anti-monopoly law", clear the division of the jurisdiction and establish coordination and cooperation mechanism between competition authorities and sectoral regulators.
