Legal Research On Rights And Interests Safeguard Of Landless Peasant In Land Levy

In recent years, the landless peasant has become a prominent problem in China. One of the negative effect of the rapid development of China's urbanization is a large number of landless peasants .The emphasis of this paper is legal protection on rights and interests of landless peasants. The paper to the situation of landless peasants in Urumqi County as an example, through the investigation to understand the status of landless peasants and social problems raised by the landless peasants and analysis the reason that arises., while introducing foreign land requisition system and draw their own merits, obtaining the conclusion that our land levy system have defects .This paper also obtain the conclusion that because the collective land ownership in China is unknown, and not the true sense of ownership that lead to the state have the power of arbitrary imposition of collective land, increasing the number of landless peasant exacerbating the contradiction ,which is not conducive to "three rural issues" resolved and harmonious society.By means of the discussion ,the author put forward legal countermeasure to solve the problem's mentality and the perfection of land levy system of our state ,from several aspect such as the purpose of land levy, the process of land levy ,the compensation and arrangement of landless peasants to discuss. At last, the author have the conclusion that our land levy system formed in the planned economy era and in the market economy is not applicable, in other words, can not accommodate the peasants who lost their land under the market economy system to survival,employment and progress.The author suggest to reform our land levy system to resolve the problem of landless peasant.
