The Research On The Effectiveness Of Lawyer's Legal Aid System

Legal aid is a kind of legal protection system which provides free legal assistance and services to citizens in financial difficulty or parties in special cases. It plays an important role in maintaining social stability, promoting judicial justice, social equity and justice, and promoting the economic and social development. Lawyers make great contributions to the establishment and development of legal aid system in our country. However, under the present situation, lawyers and legal aid system are not harmonious and certain problems still existed between them. This situation directly leads to inadequate legal aid effectiveness and will also affect the function of the realization of the legal aid system. To ensure that legal aid work carried out, we must make an intensive study of the effectiveness of legal aid by lawyers. In this paper, the author combined theoretical exploration and empirical research methods to probe the effectiveness of lawyer's legal aid system and the reform of it.Besides the introduction and conclusion, the body of the paper composed of three parts.In the first chapter,a concise explanation of the effectiveness of lawyer's legal aid is summarized. By introducing concept of the legal aid, analyzing the relationship between"governmental responsibility"and"lawyer obligation", the author defined the concept of lawyer's legal aid system. Effective lawyer's legal aid system plays an important role in protection of human rights, social security, justice, social harmony and stability. This is the theoretical basis for the effectiveness of legal aid.In the second chapter, there was a positive analysis of the effectiveness of lawyer's legal aid. In order to counsel the effectiveness of the lawyer's legal aid system more deeply, the author define the scope and object, use appropriate research methods to achieve the survey purpose. Through the survey, we can acquaint the actual working condition of lawyer's legal aid, and discuss the reason for the effectiveness of lawyer's legal aid system less than Genesis at present. This is the precondition of putting forward reasonable suggestions for the effectiveness of legal aid.In the third chapter, there was the suggestion for the effectiveness of lawyer's legal aid. The author offers suggestion from five aspects: expanding the scope of legal aid; perfecting lawyer's right and improving their status; establishing quality control system and the protection of legal aid funding mechanisms; reforming lawyer system, establishing of legal aid stated-sponsored lawyers team and establishing and perfecting legal aid duty lawyer system with Chinese characteristics.
