It is more than twenty years since the resumption of labor disputes handling system in China late nineteen eighties. During this, in China the establishment of the State-owned company reforms and the modem enterprises system took shape under the background of the ceaseless development on socialist market economy and the in-depth step on reform of the economic system. Meanwhile, the labor relation was in a subtle transformation period and in this process various labor disputes are ceaseless emerge in large numbers presenting some new characteristics. The system which was used at present obviously could not adapt the need of the present practice. The urgency of reform on it presents like an arrow on the bowstring. This thesis aims to unify current system and innovate institutional and mechanisms through the author's own effort in order to promote the establishment and fully consummation of the Labor disputes in the dispute settlement mechanism.This paper was divided into three parts:The first part, the author makes some comments on the present labor disputes in the dispute settlement mechanism to seek the defect and shortage, highlighting the necessity and urgency of reform.The second part is for the analysis on the malpractice of the labor dispute settlement mechanism settlement which was currently used in our country.The third part, mainly introduce and recital the domestic present more popular viewpoints on the salvation of labor disputes, analyzing advantages and disadvantages in order to utilize it after taking its flower and going its scum.The forth part, this is the core of this paper and mainly discuss the author's idea on constructing labor disputes handling system.
