The Impact Of The China's Traditional Legal Values On The Modernization Of The Rule Of Law

Nowadays, our country is during the period of founding the modernization of the rule of law, and the Construction of the rule of law need the legal values of the all society as the basis of thoughts and theoretical guidance expect the material and class basis of society.The legal society need all citizens to have the right legal values to adapt to times. But on the other side, China traditional legal values have very important impact on the legal modernization. Research on the China traditional values, we can master the beginning,development of China traditional legal values, and the law that the legal conception's impact on the society, As to find the way how to guide the traditional legal values , and make the legal values are more adapt to the need of the legal modernization in China.For the research, I read many documents . Firstly I choose the objective ones that adapt to the need , and through the thesis , I found some useful theory to my research. My teacher and students were very helpful to me, through communicating with them , I can found the wrongs which need Change in my research , and exploit my ideas in order to make the thesis's content adapt to the need which are objective,real and constructive.Through the writing, I thought that China traditional legal values have long history. It started in the specific period, and changed with the change of economy and political, and still have important impact on the legal practice. During the period of feudalism and slavery. China traditional legal values was just to be the tool of political. Without the value core that democracy,human right,fairness,justice which the need of the legal modernization. But at the same time, in the law history the traditional legal values also take an active role on the governance of the society, and the heritage of the conception is the law of the history and human society. There is no way to dismiss the traditional traditional values . So I think that under the premise that construction of the legal modernization, we should take the attitude of Abandoning to the traditional legal values. One hand, the construction of the legal modernization must adapt to the socialist modernization, and thoroughly dismiss the content which are tyranny,feudal,Brutal in the traditional values. But on the other hand, we need find the valuble ideas stilly to keep and develop them. What's more, we can use them when we construct the modernization of the rule of law, to promote the it.
