Along with the development of science and technology, human kind finally fulfills the dream of space travels. However, ever since the Cold War, in order to obtain hegemony in outer space, some states have begun the research of outer space weapons. Outer space weaponization goes against human peaceful usage of the outer space, and will hinder the peace and development of mankind. Outer space weaponization has always been focus of international community, and certain progress has been made. However, current legal system, including TheOuter Space Treaty and many other international treaties, has failed to resolve this problem efficiently. Therefore, the international community has to achieve a new international legal instrument as soon as possible. In all sorts of legal method, the traditional international treaty and emerging code of conduct appears as two desirable choices.International treaty is the most important regulation form in modern international law. Although, treaty has some disadvantages, such as fragility, treaty has many advantages, such as the most significant legal resources. International treaty is still the most practical legal method to prevent outer space weaponization by comparison. The flexibility and adaptability of code of conduct can be of great significance. To some stares, code of conduct is a agreeable choice to this problem. However, Code of conduct does not have legal binding force. This is the most lethal disfigurement of code of conduct. Nevertheless, international treaty and code of conduct can work together as a team, which leads to a better consequence.Therefore, a new treaty shall be reached, while a code of conduct could assist the enforcement of the treaty. The combination of these two could contribute a lot.
