Legal Regulation Of Militarization Of Outer Space

Along with human exploration of outer space, for sovereignty, outer space has developed various meanings on survival and development. Peaceful use and seeking common human welfare is the basic principle of outer space exploration. The rapid development of space technology in 20th and 21st century has made military activities in outer space become white hot. Outer space has become a new battlefield. The experiment on X-37B Orbital Test Vehicle, April 2010, raised debate on the militarization of outer space again. The militarization of outer space has become an indisputable fact. This article analyzed the development of outer space military science, the development of outer space military strategy in national military policy, the changes on the pattern of behavior of outer space militarization. The article also concluded the laws related to the militarization as much as possible, not only earlier legal regulations, but also recent efforts on limitation of outer space militarization made by the world. Those laws which are yet to come into force are also studied and discussed.Deficiencies of the laws on preventing outer space militarization are also summarized. By analyzing the trace of development in these materials, this article will make a conclusion considering various points of view and the characteristic of outer space militarization. Based on these studies and combined with some of the developments in legislation which are recognized by the international community, the article discussed the way of legal construction of outer space militarization. This article suggested that making a difference between two kinds of military space activities while legislating and the adaptability of legislation are the most important before improvement of regulations of militarization of space, as well as the importance of adaptability of space militarization technology. Improving the present legal regime should step some paths, such as enhancing and clearing the function of relative mechanisms of legislation and negotiations of space militarization issues.
