The term of part-time labor, which corresponds with full-time labor translates from part-time labor in English. There has been a long history of development of the form of part-time labor around the world; the speed of its development is also relatively fast. It is the main form of flexible employment or informal employment in each country. However, the development course of part-time work in china is not so long, it almost can be considered as a new form of labor which was developed in the period of market economy after reform and opening up.As a result of cultural differences in national laws, as well as the differences of part-time work on the development background and circumstance in all of countries .All of countries on the definition of part-time labor are also different. From the whole part which countries define part-time labor .All of them define part-time labor based on the definition of the full-time labor comparatively. This thesis analyzes the scientiflc rationality of the definition of part-time labor relation in our country's"labor contract law"through interpreting the different definitions of part-time labor relation international labor organization as well as outside the countries and regions and our countries local legislation, it has a positive significance for the research of part-time labor relation. The part-time labor for workers in a part-time form of obtaining employment and for the employing units is a part-time form of engaging the employees. The part-time labor relation has a positive side and negative side to the development of our country's work force market when it is considered as a new type of flexible labor relation. Getting rid of the disadvantage and developing advantage is the guiding ideology of legislation. The labor regulations also present the guiding ideology in the regulating the part-time labor."labor contract law"constitutes special regulation according to the special aspects which part-time work relation is different from whole work relation, this series of special regulations has a positive function of regulation the current part-time work relation in our country. However, at present the legislation of part-time work relation still under the groping period, we also need to improve legislation to promote the healthy development of part-time work relation and provide a strong legal protection for part-time workers.
