The Research Of The Influence Of The Government In The Transaction Of Construction Land Collectively Owned By The Peasants

The entering of rural collective construction land into cities has become a main method of complementing the shortage of urban construction land. In fact the transfer of rural collective construction land is also an exhibition of the land development right. According to the study of current literature, the typical modes developed after the experimental trials of some cities include: Suzhou mode, Wuhu mode, Huzhou mode, Shunde Mode and so on. Now all levels of governments are actively promoting the transfer of collective construction land. Shanghai is also actively exploring the methods of transferring rural collective construction land and has carried out trials in some suburb districts. This article firstly analyzes some typical development modes of domestic collective construction land and illustrates the actual situation of experimental trials of rural collective construction land in Shanghai. At the same time this article interpretes some legal concepts such as collective construction land, ownership of collective construction land and usage right of collective construction land. Then aiming at some problems during current transferring process of rural collective construction land, such as the unfair phenomenon in the interest distribution of actors, the occupying of most of peasants'interests and the functional absence of governments during the promotion process, this article raises some improving measures based on the general requirements of Scientific Outlook on Development and some domestic and overseas beneficial methods, in order to project the obligatory government influence on promoting the transferring of collective construction land, further perfect the work institution of rural collective construction land transfer, promote harmonious society, and provide powerful theoretical support.
