Study On Community Youth Under Law And Order

Community youth is a delinquent high-risk group, and delinquent community youth account for 60% of the total delinquent youth. In 2004, National Working Conference on Prevention Youth from Breaking Laws and committing crime and the School and Peripheral Public Security Comprehensive Administration points out, minor, community youth, young peasant worker, crime wrong youth are the emphatic groups. Community youth problem is a complex social problem caused by many factors, which is related to Macro background of politic, economy and society, and which is related to the systems of education, employments and administration, and which is also related to their ability, family, education, etc. Community youth is out of school, and unemployed, and they are not sensible. They are not only apt to commit crime, but also easy to be injured. Before committing crime or being injured, many community youth who have committed crime or been injured are not regulated by family, school and society. They are out of social control system. Their social relationships network is very weak. Compared with adult, youth are the vulnerable groups; Compared with other youth, community youth are the vulnerable groups. We should think the problem of community youth from wide, far-reaching visual angle, and can't give them a card to such degenerate labels as "question teenagers", "bad teenagers", etc. because of their passive existence. In essence, the work of community youth fairs is not only work of delinquent prevention and control, but also service work of safeguarding their interests and protecting their healthy development. The central authorities require clearly that, all parts shall set up the regional information management system, grasp their basic situation accurately, analyse real difficulty and problem that they face, help them in study , rectify a deviation on the behavior, support them on employment, and promote them to grow up healthy and sound. Today , law is the basic criterion of people's behavior, and the important guarantee of rights of vulnerable groups at the same time. We must think the issue of community youth under law and rule. This text amounts to four chapters, its main content is divided and stated as follows: Chapter 1 carries on the discussion to community youth's concept and name , proposes three characteristics of community teenagers, has explained the progressive meaning in which the name changes. Chapter 2 analyses the relations between community youth and criminal ,between community youth and victim in theory and practice, proves the vulnerable status of them. Chapter 3 explores the vulnerable rights of community youth. Chapter 4 has analysed the special justice procedure of community youth in an all-round way from three angles of criminal justice, civil justice and administrative justice on the basis of analysing community youth's judicial situation, As one of the members of the project of "teenagers of Shanghai community working current situation and research of developing ", I have carried on on-the-spot investigation, direct interview and made investigations in a lot of districts and street of Shanghai, and has consulted and analysed and researched extensively to relevant materials and document. On the basis of this I have finished the thesis under the guidance of tutor .
