The Case Study Of The Process Of Four Times Amending Constitution

Amending　Constitution　in　our　country　are　all　pass　through　NPC　with　almost　full　agreement,　and　Amendments　are　the　copy　of　The　Party's　suggestion,　this　phenomenon　is　necessary　for　our　political　process,　NPC　rule　and　its　operation.　As　for　NPC　and　its　standing　committee　have　legal　process,　the　stage　beyond　of　legal　process　have　none　pacific　rule.　But　in　fact　the　stage　beyond　of　legal　process　already　set　up　the　consequence　of　legal　process.　Lot's　of　research　concentrates　on　legal　process　and　Constitutional　Convention,　but　for　the　important　of　stage　beyond　of　legal　process,　the　research　of　the　stage　beyond　of　legal　isn't　proportional.　　This　essay　concentrates　on　the　whole　process　of　amending　Constitution,　with　case　study　methods　and　legislation　theory　analyzing　our　Constitution.　The　text　includes　three　parts:　Chapter　one:　from　the　recollect　and　conclusion　of　our　amending　Constitution,　the　author　draw　a　conclusion,　the　whole　process　of　amending　Constitution　has　two　stages,　one　is　legal　process,　another　one　is　its　counterpart　the　stage　of　beyond　legal　process.　From　contract　the　consequence　of　the　two　processes,　there　is　little　change　between　the　Party's　suggestion　and　the　Amendment,　seeing　from　this　way,　the　stage　beyond　legal　process　is　the　key　process　of　whole　process　of　amending　Constitution.　The　stage　beyond　legal　process　is　the　key　process　of　whole　process　of　amending　Constitution,　which　has　three　reasons:　one　is　the　influence　of　The　Party,　second　is　the　rule　and　the　corporation　of　NPC,　roles　which　take　part　in　the　stage　beyond　legal　process　and　the　way　they　take　part　in　are　the　third　reason.　In　one　word,　the　same　leader,　The　Party,　controls　the　whole　process.　In　stage　beyond　legal　process,　The　Party　gives　the　suggestion　on　amending　Constitution,　the　following　legal　process,　for　The　Party　also　have　its　control　role　,　the　NPC　and　its　standing　committee　just　give　the　vote　of　"yes".　The　Party　and　the　elites,　the　main　role　that　take　part　in　the　process,　guarantee　the　democratic　foundation.　Form　the　analyze　of　the　whole　process,　the　author　draw　the　conclusion　that　the　stage　beyond　of　legal　process　set　up　the　consequence　of　legal　process,　there　are　various　kinds　of　legislation　process　value,　does　the　stage　beyond　of　legal　process　also　take　place　them?　The　author　supervises　form　seven　values,found　that　the　stage　beyond　legal　process　can't　satisfy　these　seven　legislation　process　values.　There　exist　a　contradiction　between　the　legal　process　and　the　stage　beyond　of　legal　process,　the　author　gives　two　ways　to　settle　this　contradiction.
