The issue of the patient's rights was posed with the movement of the patient's rights. On the basis of observing the movement of the patient's rights and referring widely to study results in the relative fields such as medical ethics circles and law circles,the thesis initially expounds and proves the patient's rights in the relationship between medical personnel or unit and patient. From the medical practice in our country the thesis synthesizes the rules about the patient's rights in material laws, and defines the content of the patient's rights. In the demonstration of some types of the patient's rights, referring to some relevant laws in abroad the thesis put forwards my suggestions about the perfection of the patient's rights. The paper consists of three parts: preface, text and conclusion. In preface the thesis illustrates that the patient's rights should be discussed from microeconomics at first and be discussed in the relationship between medical personnel or unit and patient, then it illustrates the significance of researching the patient's rights. Part one, the patient and the patient's rights. Firstly, the thesis introduces three kinds of concepts about patient. And it takes the third concept that the patient is a person who wants to seek medical advice and cure. Then this thesis illustrates the concept of the relationship between medical personnel or unit and patient, which is the relationship between doctors, nurses, medical technical staff, hospital administrative staff, medical health organs and patients in medical activities. Then it illustrates the types of relationship with the change of medical mode. Lastly it defines the concept about the patient's rights which is a right that is owned by a person who ask help from doctors, requiring the hospital to offer certain conditions to safeguard the patients'dignity, life and health. Part two, the historical background of the patient's rights: the movement of the patient's rights .Firstly the thesis introduces the thought foundation of the movement of the patient's rights. The patient's rights are formed and developed with the influences of western individualism thought. Then it introduces the development and achievement of the patient's rights movement. Part three, the content of the patient's rights. This part systematically and comprehensively analysis and demonstrates the content of the patient's rights in the relationship between medical personnel or unit and patient in our country. The content of the patient's rights is a key content of this text and the system of the patient's rights is a system with abundant content. Every right maintains the close ties with each other, forming a right network which protects the patient's interests together. The content of the patient's rights includes: the right of medical treatment; the right of informed-consent; the right of self-determination; the right of privacy; the right of consulting and duplicating the medical documents; the right of requiring compensation; the right of medical supervision; the right of requiring to offering medical advice; the right of applying medical expertise; the right of withdraw by petition; the right of obtaining health education. The right of medical treatment, it is a right which means that the patient has a right to ask for medical units to offer basic, just, suitable medical services. Medical right is a basic right in the patient's rights. The right of informed-consent, it is a right which means the patient has the right to be informed well certain medical information and to make promise. The right of informed-consent is the key of the patient's rights and is ameasure to achieve other rights. It includes two parts bonded together: the right of informed and the right of consent. The right of informed means the patient has the right to know the nature, severity, healing solution, prognosis about the disease that he suffered. The enforcement of this right depends on the hospitals'informing obligation. Forms of informing can be oral, or in written, behavioral. The right of consent means that the patient agrees to the medical suggestions. There are three forms of agreement forms: Oral, in written, behavioral. In special circumstances, the emergency patient, critical patient can be told afterwards according to the situation. And the hospital also can tell their relatives. The right of self-determination, it is a right that the patient enjoys independently decides in the medical courses. This part expounds three rights: the right of choosing doctor, the right of giving up treatment and the right of refusing treatment. The right of privacy, it is a right that the patient's personal information and private field aren't known and interfered. It can be divided two parts: the right of utilizing privacy and the right of secreting privacy. The first one means that the patient has a right to reveal his privacy to specific medical workers in order to treat his disease. The second one means that the medical worker keeps a secret about the patient's personal information learnt. And the right of privacy should be limited by public interests and the others interests. The right of consulting and duplicating the medical documents, it is a right which means that the patient has a right to consult and duplicate the medical documents about his disease.
