The Econimic Analisys On The Ankrupt Law

Different from the most fore-research on bankrupt law, this article is about economical efficiency, not social equity.Comparing the different concepts in different fields of bankrupt and bankrupt law, reviewing the china history of the bankrupt law's legislation, then this article uses the tools of the institution economics to clearly define the concepts such as property rights, transaction cost and splits the progress of bankrupt into fore phases, "claim rights on debt", "definitude the bankrupt property" and "equal allotment". There exist the transaction cost and the games between the creditor and debiter.To the different problem, this article gives the various advice on the bankrupt law, each of which aims at the improvement on the economical efficiency.
