Research On The Law Of Safeguarding Mechanism In The Narrow Sense Under WTO System

WTO needs to realize its set target through compound operation of various mechanisms in its self developing process, which is decided by the characteristics of WTO multilateral trading system. Among this, the chimerism operation of market entry permitting system and the safeguarding system are the main ways and methods for multilateral trading systems to adjust international trading and promote the development of multilateral trading.As the safeguard mechanism of multilateral trading system's adjusting methods, it has taken the responsibility of the safeguarding of each member country's branch systems in multilevel and omni-directional ways, its interior structure is quite complicated, and its safeguarding functions also varies from the different interior structures of the branch systems. The Industry safeguarding mechanism under fair conditions is always one of the basic and core contents of complete safeguarding mechanism.China is developing to the market economy, and until now, its self economic and trading structure still needs improvement, so, it has quite important meanings both in theoretical and practical ways for China to Improve and perfect the industry safeguarding mechanisms in a fare condition and according to the WTO regulations, so that in the process of further opening up of market economy, we will control the shock to the domestic relating industries to the lowest, and do not destroy its self industry.This thesis begins with the research of basic problems of law of safeguarding mechanism, analyzes the designing thoughts and defects at GATT period, and explores the evolutionary causes and process from GATT to WTO for safeguarding mechanism in the narrow sense. It discusses about the body part of safeguarding system in narrow sense, the Agreement on Safeguarding Methods, that is the implement of entity and procedures. The thesis also gives his own thoughts and suggestions on the construction and improvement to our country's narrow-sense safeguarding system: build up gaming safeguarding mechanism in narrow sense, on base of integration of law origins and judging on import and export safeguarding systems.
