Research On Safeguarding Of Rights For Industry Union Of China

In recent years,with the rapid growth of various fields,there has been a surge in cases of labor conflicts in the field of labor relations,and the society is paying more attention on safeguarding of the labor rights.The Trade Union Law of China makes it as the basic duty and commitment of trade unions at various levels to firmly safeguard the legal rights of the workers and General Secretary Xi Jinping requested that where the legal rights of workers have been infringed,where the trade union should stand up for them.As it accounts for almost half of the trade union,industry association has long been committed to the team building of industrial workers and safeguarding the industrial workers' rights,contributing its due efforts to fostering a harmonious relationship within the industry.However,due to some subjective and objective causes,there have been many restrictions for industry associations of various levels in safeguarding workers' rights,which can't meet the growing demand of the workers.As industry associations are more connected to the workers and are more familiar with relevant industries,they should play a key role in the national trade union reform and contribute more in terms of safeguarding workers' rights.It represents an important issue with the industry union management on how to better safeguard the workers' rights.By giving an example of seamen's union of Shandong,this thesis analyses and discusses the safeguarding of workers' rights of industry associations in terms of theories,practices,issues and solutions.In the first part,it point out the background and purpose of the thesis,sums up the overseas and domestic researches and puts forwards the research concept.In the second part,it elaborates on the basic concept,the parties involved and the bases in claim of rights.The third part expounds the experiences of seamen's union of Shandong on how to intervene directly and from the beginning of claim.The fourth part analyses the causes resulting in the challenges in safeguarding of rights from three perspectives,i.e.insufficiency in institutional and structural layout,inadequacy of legal support and forceful measures.The fifth part gives an analysis on the new missions/tasks in the new era,and then sets forth solutions to improve on the safeguarding of workers' rights from the following: self-improvement,intervening from earlier stages,improving three-party mechanism and attach more importance to skill training.
