Studies On Electronic B/L And Legal Issues Concerned

This paper investigates in detail issues concerning the introduction of Electronic B/L and put forward some arguments. Through reading some relevant law books and laws and after the consultation to some professionals, a study and discussion was made on it. Chapter 1 is mainly about the definition, characteristics and development of EDI and Electronic B/L; introduction of two operation modes: CMI & Bolero. In chapter 2, it focuses on the study of the relevant of Electronic B/L and contract, including mainly the followings: the definition of Electronic Contract, the relevant between the Paper B/L, the international sea transport contract and the limitation of the stipulations in the Contract Law in China. In Chapter 3, the written form of Electronic B/L, existing in form of electronic data and its value as evidence is analyzed. The thesis dwells on the relationship between the Electronic B/L and written form. After researching the relative national and international regulations, the author brought forward the following solutions: contract and legislation. Chapter 4 consists of mainly the evidence type of Electronic B/L. Though contrasting the different regulations between the Common Law countries and Civil Law countries, the author points out that the Electronic B/L is a new kind of evidence. One should judge it according to the detailed fact instead of the traditional standard. In Chapter 5, it highlights the legal basis of issuing and transferring Electronic B/L, the safety of signing and issuing of the Electronic B/L; the system reliability, the authentication of the subscriber, the security of the data message, the digital signature and the relevant legal issues.
