Lawyer's civil liability, which should bear for his misconduct during law service, is a kind of lawyer's practice liability. To set up and perfect the system of lawyer's civil liability can make lawyer protect the party's legitimate rights and interests, improve the community trust in lawyers, and facilitate the sound development of this career.Lawyer's civil liability, one of the civil liabilities, belongs to specialist's liability. Lawyer bears contractual liability as well as tortuous liability. The obligee, who advocates that lawyer bears civil liability, is not equivalent with lawyer in legal knowledge. This situation makes them in unfavorable condition compare with the lawyer.This paper begins with the application of law of the lawyer's civil liability, get some insight into the comprised elements of it, then, analyze with the cases in the real life. In the end, put forward my views on insurance and system relate to the lawyer's practice liability.
