Study On Lawyer's Civil Liability

Lawyer's systerm is one of the basic content in the political system of democracy of a country,and lawyer's liability onstitutes an important part of the lawyer's systerm. When a lawyer has caused the party's lost consequence during the process of dealing with legal affairs, he should be investigated for his lawyer's civil liability. As we know,civil liability refers to the legal liability which a civil subject shall bear duo to act against civil obligation or infringement. But lawyer as a person of law follows the requirement of law occupation ethics. Thus lawyer's civil liability posseses general character besidea its own particularity. In the relations of rights and obligations between lawyer and client or the relative third person, Lawyer civil liability plays a role in holding the balance.Therefore,in this thesis,the author discusses the nature,theoretical foundation,constitutive requirements, restriction, exception condition and the construction of system of the lawyer's civil liability on the basis of investigation about the liability to make compensation for lawyer's practice,so as to improve this institution gradually in our country.
