For a long time, human beings regard themselves as the dominance of the nature, taking the conquer of nature as the symbol of progress of historic civilization, and conduct a persistent fight of demanding and deprival The human traditional ethic theory has changed greatly, with the development of science and technology and deeper insight to the relationship between the earth and the universe, especially the biological impact on the natural and social science. Humans reflect on the reason, consequence and solution to the environmental pollution and destroy of the nature.However, under the circumstances that scientific philosophy has not changed and the being of collision of the new and old values, main tendency of law is to maintain the justice based on traditional morality, that is ,to modulate the human's social relationship.On this condition, law can object on the human's behavior in the course of rebuilding and application, which insures that traditional law could only make the human as the center, and focus on the social relationship of human beings. Human's demands and the pursuit of profits are endless, and the recourses that meet the human's demand is comparatively limited. Human needs the earth, which is the only one in the world. The immoderate development is bound to cause the day of recourses exhausting. How to protect biological environment? This essay offers the answer in terms of the punishment of the criminal judge. After combining the feature of china's biological crime, consulting the relevant experience of the foreign law and analyzing the problems existing in china's measures to the punishment of biological crime, the author proposes the opinion creatively in terms of values, theory and system of biological crime.
