A Study On BOT Way And Legislation

BOT way is a kind of new-type international investing and financing way that rose in the eighties of the 20th century. Because this new kind of investing and financing way can attract private capital of both overseas and domestic to the infrastructure construction field, having many positive roles, such as lightening the government's financial burdens, reducing government's debt risk, etc. It has been widely accepted and used by the countries all over the world, especially by those developing countries. In this thesis, firstly, the author explains the basic theories of BOT, the new-type investing and financing way, proposing to introduce BOT way to the field of our country's infrastructure construction, with the aim of solving the long-time bottleneck problems of infrastructure, such as problems of traffic , energy ,etc, which limits the development of our national economic. Secondly, this thesis analyzes the background of applying BOT way in our country, claiming that it is necessary and feasible to apply BOT way in our country. Meanwhile, the thesis analyzes the problems and experience of applying BOT way in the development strategies of regional economy and in the Western Development and in revitalizing the economy of the Northeast Industrial Base. Finally, the author analyzes the current situation and existing problem of legislation of BOT way in our country, bringing forward the perfect mode selection and content of legislation of BOT way, explaining the general principles, procedures and entities of legislation, giving some rational advice on the legislation of a set of laws correlating with BOT way.In order to play the positive role of BOT way, it is necessary for us to carry out the research to BOT, to apply the investing way to the infrastructure field, turning it into the practical economic benefits and social benefits. On one hand we should not be too conservative in the thought, should give great support and create excellent investment environment to BOT way; on the other, we should make legal regulation for BOT, establishing effective BOT laws and regulations as soon as possible. In a word, we should set up a steady, transparent, perfect legislation system to BOT way.
