Study On Legal Protection To Water Resource Security In China

Water is source of life, one of three strategic resources in social and economic development and the foundation in sustainable economic development . But we are facing serious crisis of water resource security. So it is necessary to strengthen the legal protection to the water resource security in our country. Beginning with severe situation of water resource, the dissertation discusses the meanings of water resource security, analyses the problems in the legal protection to the water resource security and puts forward some countermeasures of water resource security by benefiting from advanced experiences in foreign countries. The dissertation is divided five chapters: In Chapter One, the current situation and problems of water resource are explained. In Chapter Two, the basic theories on legal protection to the water resource security are discussed, including the definition of the water resource security and the necessity and the feasibility of legal protection to the water resource security. In Chapter Three, the basic situations of legal protection to the water resource security in the U. S,Mexico,France,Australia and the history of legal protection to the water resource security in our country are studied and experience and inspirations that can be drawn are presented. In Chapter Four, the problems of legal protection to the water resource security are analyzed in details, including three parts: a. an outline of current laws and regulations on legal protection to the water resource security; b. problems from the aspect of civil law; c. problems from the aspect of international watercourse law. In Chapter Five,, as far as legal protection to the water resource security is concerned, advice and proposals are given after analyzing the problems. These include: making good use of international watercourse law to protect the water resource security and perfection of civil law, such as making water-saving law, perfecting management system of water valley, making the relevant laws more operative and so on.
