Legal Study On Commercial Banks Within The Financial Control

Along with the further growth of market economy in China and the acceleration in the trend of financial globalization, financial control will play an important role in Chinese macro economic control. Facing the reality that financial control is lacking in ability, it's very important obviously to strengthen financial control and evade financial risk. Seen from legal angle, financial control needs to have two basic premises so as to make it take effect. On one hand, we need improve legal regulation of financial control in operating system and legal system. On the other hand, We should build up a sound micro financial foundation, which bases on the reform, development and legalization management of commercial banks.Confusion in legalization management of commercial banks from the angle of financial control can't do good to the development of commercial banks. What's more, the legal system and inner-controlled management of Chinese commercial banks are still not perfect. Consequently, it is urgent for us to strengthen financial control and guarantee operation steady for commercial banks.The article is divided into four parts as follows:The first part elaborates mainly those basic theories of financial control. It analyzes theoretical basis, function as well as legal means of financial control, and then focuses on the relationship between financial control and commercial banks.The second part makes study of status quo of Chinese commercial banks. Firstly, this chapter reviews the systematic evolution of Chinese commercial banks in order to expose the source of those problems existed in commercial banks. Secondly, it analyzes the characteristics of commercial banks' behavior so as to make the impact on financial control clear. In the end, it elaborates the major problems of our commercial banks existed in inner-controlled management and legalization management.
