The Studies On Law Issue Of The New Basle Capital Accord

The New Basle Capital Accord framework had formally publicized in June 2004. On the background of finance developing globally, the New Basle Capital Accord which summarized the experiences of former Basle principles and agreements, at the same time, absorbed the method of management of advanced banks in the world today, became a capital measurement and supervision of risks framework which major contents are composed with three pillars. The New Basle Capital Accord is an international copy of supervision of international banking, that the banking of our country must study and learn hard, if we want to obtain an advantage position in competition.This thesis investigates the three pillars of the New Basle Capital Accord mainly, which analyzes the influence for our country banking putting the three pillars into practice, in the end, the author puts forward supervisory suggestions of perfecting our country banking with using for reference of the New Basle Capital Accord. The article is divided into five greatest parts totally: The first part introduces the principles and agreements and their important meanings which Basle committee announced anciently; The second part clarifies the formative process and new characteristic of the New Basle Capital Accord frame; The third part discusses the three pillars of the New Basle Capital Accord in detail, minimum capital requirements, supervisory review of capital adequacy, and public disclosure namely; The fourth part enumerates the problems of our country banking at present and analyzes the influence for our country banking with implementing the New Basle Capital Accord; The fifth part is the core of this thesis, studying the New Basle Capital Accord is to draw lessons from the advanced production of international banking and increase our country banking level of supervision, therefore, the writer table strategies and proposals which to consummate our country banking.The article which uses the methods of contrast, excerpt and give examples, dissertates around the three pillars tightly, and at length, it presents advices aiming at the three pillars.
