Study On Law Control To International Cooperation Of Resource Security In China

The situation of global environment and resources has changed a lot since 1950's with industrialization and urbanization and expanding population. So people have attached importance to the theory of resource security. Resource security is such a specification that natural resource can be constantly, stably, timely utilized by the people who is in the contemporary era and unborn of a country or region; meanwhile, it can ensure natural resources and environment have been preserved well. The resource's disadvantages and contradiction of supply and demand in China is obvious. It is a great trend to develop international market of resource and seek international cooperation in resource security according to the strategy "go out and importation". However, the resource globalization is not only an opportunity but also a challenge to resource security in our country. So, we should have a good sense of the resource globalization's negative influence and perfect the related legislations to ensure the international cooperation of resource security. Consequently, on the basis of some theoretic of resource security in the world the paper discusses the evolution of resource security and its concept, the author considers that "resource"in "resource security"should be substance resource, and then promotes the concept of international cooperation of resource security and the approaches. In the thirdly section, the paper demonstrates the necessary and feasibility of international cooperation of resource security. In the forth, it points out the limitation of the legislation on international cooperation of resource security. In the fifth, firstly, the author brings forward we should perfect the legislation to protect international cooperation in resource security; secondly, we should persist in the basic legal principles on international cooperation in resource security, such as the principle of permanent sovereignty on resource, the principle of resource's sustainable exploitation, the principle of equality and mutual benefit and so on. And we should perfect the foreign trade law; the foreign capital law and offshore fund law and make good use of "internal and overseas market, internal and overseas resource". Only in this way, I believe, can we gradually set up and perfect the legal system of international cooperation in resource security.
