Study On The Administrative Permission System For Alien Species Introduction

The development of international trade and economy integration accelerate the ex-introduction of alien species and alien species invasion between countries , which has caused great economic cost and damaged people's health seriously .Even worse ,alien species invasion may also cause the reduction of the world's species and gene variety ,destroy the world's environment and so endanger human beings living .In a word ,alien species invasion has become a world's environmental problem.Our country is among the ones who suffer great from alien species invasion , but over half of the invasive alien species were introduced into our country by people intentionally . So it is not only necessary but urgent to establish a system to control the activities of intentional alien species introduction , which is also thought to be the safest ,the most economical and efficient way to prevent alien species invasion .This dissertation intends to establish a system of administrative permission for alien species introduction under the administrative permission law of PRC .It begins with some conceptions of the system ,then analyses the necessity, urgency, validity and reasonableness of the establishment of the system ,at last , it offers some practical suggestions ,first is for the system's legislation ,second is for the main contents and the third is for its intendance and liabilities.When studying the establishing of the system , this dissertation emphasizes that every part of the system must be designed reasonably and legally ,the system must be useful to prevent alien species invasion , efficient to control the administrative power and also must show absolute respect to citizens' rights . Employing legal methods of dialectic materialism and historical materialism , adhere to integration of theory with practice , considering the theory and regulations of jurisprudence ,environmental law ,international law ,administrative law , this dissertation establishes the system of administrative permission for alien species introduction perfectly ,which can be applied to the administrative management of alien species introduction practices and offer theoretical guidance for it at present and in future.
