A Study On The Application Of International Maritime Treaties In China

The issue of application in China of the international maritime treaties ratified or acceded to by China has not been solved yet. Due to lack of specific statutory provisions, disputes often occur regarding application of the treaties in academic circle and admiralty judicial practices in China. To solve this problem, the dissertation makes a research on the condition, principle and mode of the application of international maritime treaties based upon the theories of international treaty law.The author expounds firstly the concept and characteristics of international maritime treaties, and the relationship between international treaties and domestic laws. Then, the author focuses on the condition and mode of the application of international maritime treaties. On the basis of the above, the author makes some suggestion on the legislation regarding the application of maritime treaties.
