The Research On The Legal System Of Domestic Application Of The International Treaties

International Treaties are the important tools on the field of international politics, economics and diplomacy, and they are also the most important sources of international law. With the reforming and opening policy of our country, China has increased in the number of the treaties it has entered. This requires that our country shall establish a perfect treaty‐application system. Therefore, the application of the treaties has a meaningful and profound influence.The essay began with the theory of the treaty application, then combined with the practice situation of the treaty application in China, also drew on the experience of the US and the Britain, ended with giving advices to the treaty application system in China. The author focused on the3main topics in the essay: the application method of the treaties, the stage of treaties in the domestic law system, the way to settle the confliction between domestic law system and the treaties. The author used Contract, Examples and Discriminates to discuss the main topic.The First Chapter is the Summary of the essay, began with the interpretation of the application method of the treaties, basic principles, the stage of the international treaties in domestic law system, and all of the above mean to sort out the related complicated problems, to form the foundation of the essay.The Second Chapter is the introduction and the discussion of the U.S and the Britain’s treaties application system. On researching the form and development of these two countries’ main contents, the Author gave out the objective comments, in order to use the experience of these two developed western counties.The Third Chapter is the main part of the essay. It began with inducing the legislation of the treaties application system, analyzing the problems of the present system, ended with the advices of the current system.
