The members of WTO must obey the rules of GATS and GATS is the first multilateral rules for international trades of service. After China entering WTO, our maritime transport service trade is not only regulated by laws of our own country, but also by rules of GATS. And it is also influenced by international treaties about maritime transport service between China and the other countries. First, this dissertation introduces different laws, regulations and treaties under GATS which regulate China's maritime transport service, and gives a deep analysis and research on the related rules and principles of GATS. Then it discusses the degrees of agreement between the real opening level and the promises. And next it points out some defects of the domestic laws and regulations on maritime transport service. And gives some suggested measures to solve those problems. Finally, it also analyzes other international treaties which influences our maritime transport service and gives some suggestion to how to apply those treaties in our country.The first part of this dissertation has introduced the rules of maritime transport service under GATS. No doubt, our legislative and judical activities must obey those rules; many other theses also has talked about that But the difference is, this dissertation not only has talked about the martime transport service rules under GATS, but also has introduced the new negotiation about maritime transport service in Doha. Next it pointed out the difficulties of the new negotiation and predication has been given. It hopes that this part will give somewhat help to people whose work related on maritime transport service.The second part has introduced our promises on maritime transport service when China entered WTO; and also, the real opening level. After comparing with the other countries we knew that China's opening level on maritime transport service is relatively high. China has given higher promises on international ocean transport, auxiliary services, inland waterway transportation, port services etc. And on the other hand, China has reached a higher real opening level on market entrance admittance, national treatment, liner transportation, auxiliary service. So our real opening level already satisfies WTO reguirements.
