The Study On The Construction Of Chinese Armymen's Insurance Legal System

The character of armymen's occupations is dedication, sacrifice and high risk. Soldiers hope that their legal right and interest should be safeguarded when devoting themselves to the motherland. Many countries try their best to build and perfect the armymen's insurance system and endeavor to safeguard army men's right and interest. The armymen's insurance system has been established and implement in China, which could alleviate the misgivings, safeguard the armymen's right and interest, strengthen the coherence of the army, enhance the battle effectiveness, ensure a long period of safety and stability in China. As a soldier, the writer should research the Chinese armymen's insurance system on theory and practice and bring forward main countermeasure to innovate and perfect the Chinese armymen's insurance system for protecting armymen's justice right and interest, which could inspirit them to dedicate themselves to homeland with much more ardors.In this dissertation, the subject is the study on the construction of the armymen's insurance legal system. The armymen's insurance is the important part in Chinese social insurance system and the main content of the army's social security system. Actually, armymen's insurance system is the armymen's legal system in certain meaning.Starting from the basic theory of the armymen's insurance legal system, the writer first use legal theory about "The nature and status of law", "The relation of law", "The characteristics of law" and so on, have a research on the theory of the Army men's insurance legal system as a kind of system arrangement, which is very important in establishing our legal system for armymen's insurance.Then, the methods of combination theory with practice, comparison, history have been used in the dissertation. The writer investigates the history's development of theory of armymen's insurance, introduces the primary achievement in the armymen's insurance system, systematically analyzes the main problem of Chinese armymen's insurance nowadays;explore its developmental path and obstacles.At last, the writer scientifically establishes the basic principle of Chinese armymen's insurance system and spells the differences on the armymen's insurance system between the developed countries and developing countries. The armymen's insurance model is different in many countries, which have advantages anddisadvantages. We should note and learn from the experiences of these countries.Through the study, The writer puts forward the mode of Chinese Army men's insurance system which includes the central system, marginal system and assistant system, pointing out shortage of present army man's social insurance system which should be improved immediately and the inadaptable parts should be amended then establishing and perfecting the Chinese featuring armyman's insurance legal system according to the present situation.
