Electronic banking has its special content and form of risk. The marketaccess supervision for electronic banking and the security evaluation ofinformation system for electronic activities will improve the risk managementability of banking for its own electronic activities, and accelerate the steadydevelopment. So the market access supervision for electronic banking isspecially important. This article discuss its necessary quality and the riskmanagement principles first, then make the analysis of legislation's target,system and requirements for market access in our country on the base ofcomparing the market access regulations and supervision frame of foreigncountries in order to make some suggestions for the legislators to perfect themarket access supervision. The research methods used in this article includecompare analysis, demonstration, law-economic analysis and so on.As a result of applying internet technology, the market accesssupervision for electronic banking is different from traditional banking interms of function orientation, legislation frame, manager qualification andcapital fund with change, especially the new content of strategic risk,operation risk, reputation risk and compliance risk. Accordingly electronicbanking supervision should transfer from criterion to risk supervision.The existing market access regulation in our country is not particularenough and short of restriction for technology risk. This article analyze thedifficulties for moderate supervision and suggest market access supervisionshould be prudent and dynamic. The chief objective is to reduce the risk andto protect the client benefit. Besides some suggestions on legislation frame,subject qualification, operation area and security technology, this article alsoemphasize the requirements of inner control mechanism and risk managementability in marker access supervision for electronic banking.
